ARTICLE 1 – SUBJECT

This Contract regulates the rights and obligations of the parties regarding the sale and delivery of the product, whose qualities and sales price are specified below, ordered electronically by the CONSUMER through the SELLER's website, in accordance with the provisions of the Law on Consumer Protection No. 6502 and the Regulation on Distance Contracts.

The prices listed and advertised on the site are sales prices. Advertised prices and promises are valid until updated and changed. Prices advertised for a limited period are valid until the end of the specified period.

ARTICLE 2 – DEFINITIONS

In the application and interpretation of this contract, the terms written below shall refer to the written explanations opposite them.

SELLER: The company that offers goods to the consumer within the scope of its commercial or professional activities or acts on behalf or account of the one offering goods,

CONSUMER: The real or legal person who acquires, uses or benefits from a good or service for non-commercial or non-professional purposes,

SITE: The internet site www.lookproject.net belonging to the SELLER,

ORDERER: The real or legal person who requests a good or service through the SELLER's website,

PARTIES: The SELLER and the CONSUMER,

CONTRACT: This contract concluded between the SELLER and the CONSUMER,

GOODS: Refers to movable property subject to purchase and intangible goods such as software, sound, image, and similar, prepared for use in electronic environment.

ARTICLE 6 – PRODUCT INFORMATION SUBJECT TO THE CONTRACT

6.1. The basic characteristics (type, quantity, brand/model, color, number) of the good/product/products are published on the SELLER's website. If the Seller has organized a campaign, you can examine the basic characteristics of the relevant product during the campaign period.

6.2. The prices listed and advertised on the site are sales prices. Advertised prices and promises are valid until updated and changed. Prices advertised for a limited period are valid until the end of the specified period.

The CONSUMER accepts and undertakes to fully compensate for any damages arising from incorrect or incomplete information and also to bear all responsibility that may arise from this situation.

ARTICLE 7 – GENERAL PROVISIONS

7.1 – The CONSUMER accepts, declares and undertakes that he/she has clear, understandable and internet-appropriate information about the SELLER's name, title, full address, phone and other contact information, the basic qualities of the product subject to sale, the sales price including taxes, the method of calculating the total price, payment method, delivery conditions and expenses, etc., all preliminary information regarding the product subject to sale and the exercise of the right of "withdrawal" and how to exercise this right, official authorities to which complaints and objections can be submitted, etc., on the SELLER's website www.lookproject.net and that he/she has confirmed this preliminary information electronically.

7.2 – The product subject to the contract is delivered to the CONSUMER or the person/organization at the address indicated by him/her within the period explained in the preliminary information, depending on the distance of the CONSUMER's place of residence for each product, provided that the legal 30-day period is not exceeded.

7.3 – If the product subject to the contract is to be delivered to a person/organization other than the CONSUMER, the SELLER cannot be held responsible if the person/organization to be delivered does not accept the delivery.

7.4 – The SELLER may supply a different product of equal quality and price to the CONSUMER, provided that there is a just cause and/or in case the fulfillment of the product or service subject to the order becomes impossible, before the expiration of the performance obligation arising from the Contract and with the express and understandable information and consent of the CONSUMER. If the CONSUMER does not approve, all payments collected, including delivery costs, will be refunded to the CONSUMER within fourteen days at the latest from the date of notification.

7.5 – The SELLER is responsible for delivering the product subject to the Contract in a sound, complete manner, in accordance with the qualities specified in the order, and with warranty certificates and user manuals, if any.

7.6 Orders for products added to the shopping cart are processed after being approved by the CONSUMER. Therefore, an order confirmation message is sent to the customer before the orders are shipped. No shipment is made without sending an Order Confirmation message.

7.7 – Shopping can be done on the SELLER's website www.lookproject.net by credit card or bank transfer and/or EFT. For payment by money order, the buyer can choose the most suitable bank and make the money order. If EFT has been made, the date of deposit will be taken into account. When making a money order and/or EFT, the "Sender Information" must be the same as the Invoice Information and the order number must be written.

7.8 – Any malfunction during the order processing process, or problems that may arise with money orders or credit cards, will be notified to the CONSUMER via one or more of the phone/fax/e-mail methods specified in the contract. If necessary, the CONSUMER may be asked to contact his/her bank. The time when orders are processed is not the moment the order is placed, but the moment when the necessary collection is made from the credit card account or when the money order (EFT) is determined to have reached the SELLER's accounts.

7.9 – Orders for which a money order has not been made within one week from the order date will be canceled. Payment methods such as cash on delivery or postal checks made without consulting customer services are not accepted.

7.10 – The CONSUMER accepts, declares and undertakes that he/she will confirm this Contract electronically for the delivery of the product subject to the Contract, and that in case the product price subject to the contract is not paid for any reason and/or is canceled in the bank records, the SELLER's obligation to deliver the product subject to the contract will terminate.

7.11 – If, after the delivery of the product subject to the contract to the CONSUMER or the person and/or organization at the address indicated by the CONSUMER, the price of the product subject to the contract is not paid to the SELLER by the relevant bank or financial institution due to unauthorized use of the CONSUMER's credit card by unauthorized persons, the CONSUMER accepts, declares and undertakes to return the product subject to the contract to the SELLER within 3 days, with the shipping cost belonging to the SELLER.

7.12 – If the SELLER cannot deliver the product subject to the Contract within the specified period due to force majeure or extraordinary circumstances such as adverse weather conditions preventing transportation or interruption of transportation, it is obliged to notify the CONSUMER. In this case, the CONSUMER may exercise one of the rights to cancel the order, replace the product subject to the contract with an equivalent one if available, and/or postpone the delivery period until the preventing situation disappears. If the CONSUMER cancels the order, the amount paid will be refunded to the CONSUMER in the same way it was paid within 10 days.

7.13 – The CONSUMER will inspect the good/service subject to the contract before receiving it; will not accept damaged and defective goods/services such as crushed, broken, torn packaging from the cargo company. The good/service received will be deemed to be undamaged and sound. The obligation to protect the good/service with care after delivery belongs to the CONSUMER. If the CONSUMER exercises the right of withdrawal, he/she accepts and undertakes that he/she will not damage the product and its packaging, will not use it, and will return the invoice at the time of return.

7.14 – If the CONSUMER and the credit card holder used during the order are not the same person, or if a security vulnerability related to the credit card used in the order is detected before the product is delivered to the CONSUMER, the SELLER may request the CONSUMER to provide identity and contact information of the credit card holder, the previous month's statement of the credit card used in the order, or a letter from the card holder's bank stating that the credit card belongs to him/her. The order will be suspended until the CONSUMER provides the requested information/documents, and if these requests are not met within 24 hours, the SELLER reserves the right to cancel the order.

7.15 – The CONSUMER declares and undertakes that the personal and other information provided when becoming a member of the SELLER's website is accurate, and that he/she will immediately, in cash and in one lump sum, compensate the SELLER for all damages incurred by the SELLER due to the inaccuracy of this information upon the SELLER's first notification.

7.16 – The SELLER has the right to contact the CONSUMER for communication, marketing, notification and other purposes via letter, e-mail, SMS, telephone call and other means, using the address, e-mail address, fixed and mobile phone lines and other contact information specified by the CONSUMER in the site registration form or updated by him/her later. By accepting this contract, the CONSUMER accepts and declares that the SELLER may carry out the above-mentioned communication activities directed at him/her.

7.17 – The CONSUMER accepts and undertakes in advance to comply with legal regulations and not to violate them while using the SELLER's website. Otherwise, all legal and criminal liabilities that may arise will belong entirely and exclusively to the CONSUMER.

7.18 – The CONSUMER may not use the SELLER's website in any way that disturbs public order, is contrary to general morals, disturbs and harasses others, for an unlawful purpose, or infringes on the material and moral rights of others. In addition, the member cannot engage in activities (spam, virus, trojan horse, etc.) that prevent or make it difficult for others to use the services.

7.19 – Links to other websites and/or other content not under the SELLER's control and/or owned and/or operated by other third parties may be provided through the SELLER's website. These links are provided to facilitate redirection for the CONSUMER and do not endorse any website or the person operating that site, and do not constitute any guarantee regarding the information contained in the linked website.

7.20 – The member who violates one or more of the articles listed in this contract shall be personally responsible legally and criminally for this violation, and shall keep the SELLER harmless from the legal and criminal consequences of these violations. Furthermore; in case this violation is brought to the legal field, the SELLER reserves the right to claim compensation from the member for non-compliance with the membership agreement.

ARTICLE 8 – RIGHT OF WITHDRAWAL

The SELLER accepts and undertakes that the CONSUMER has the right to withdraw from the contract by rejecting the product within 14 days from the date of receipt or the date of signing the contract, without assuming any legal and criminal liability and without showing any reason, and that the goods will be taken back from the date the withdrawal notification reaches the SELLER.
To exercise the right of withdrawal, it is essential to notify the SELLER via e-mail or the electronic return form at www.lookproject.net within this period, that the product has not been used within the framework of the provisions of Article 7 of this contract, and that it has been returned complete and undamaged with its box, packaging, and standard accessories if any. In case this right is exercised, it is mandatory to return the goods to the SELLER together with the original invoice within 10 (ten) days from the date the CONSUMER's notification regarding the exercise of the right of withdrawal is directed. All payments collected, including the product price and, if any, the delivery costs of the goods to the CONSUMER, will be refunded to the CONSUMER within 14 (fourteen) days from the date the withdrawal notification reaches the SELLER. The shipping cost of the product returned due to the right of withdrawal is covered by the SELLER.

ARTICLE 9 – PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED

Pursuant to Article 15 of the Regulation on Distance Contracts, the right of withdrawal cannot be exercised for products that are exempt, single-use products, reproducible software and programs, rapidly perishable products or products with an expired use-by date. More specifically:
– Underwear products, all kinds of personal care products, all kinds of cosmetic products and similar goods whose protective elements such as packaging, tape, seal, package have been opened after delivery; products that are not suitable for return due to health and hygiene reasons;
– Products prepared specifically for the individual;
– Goods or services whose price changes due to fluctuations in financial markets and are beyond the SELLER's control;
– Perishable products or products that may expire soon;
– For goods that mix with other products after delivery and cannot be separated by their nature, the right of withdrawal cannot be exercised.

ARTICLE 10 – PRIVACY, INFORMATION SECURITY, PERSONAL DATA AND INFORMATION ON COMMERCIAL ELECTRONIC COMMUNICATION

10.1 - Necessary measures for the security of information and transactions entered by the CONSUMER on the Website have been taken by the SELLER within the system infrastructure, in accordance with today's technical possibilities, depending on the nature of the information and transaction. However, since the said information is entered from the CONSUMER's device, the responsibility for taking necessary measures, including those related to viruses and similar harmful applications, to protect them and prevent access by unauthorized persons, belongs to the CONSUMER.
10.2 - The CONSUMER accepts, declares, and undertakes that the personal information provided is accurate, that the SELLER is not responsible for any damages that may arise from not updating the information or providing false information, and that the information that can be defined as personal data within the scope of the Personal Data Protection Law No. 6698 acquired during the CONSUMER's membership and purchases on the WEBSITE, for the purpose of receiving orders, offering products and services, developing products and services, resolving systemic problems, performing payment transactions, using for marketing activities regarding orders, products and services, updating CONSUMER's information and managing and maintaining memberships, and performing the distance sales agreement and other agreements established between the CONSUMER and the SELLER, and for ensuring that the technical, logistical and other functions of third parties are carried out on behalf of the SELLER;
can be collected, recorded, stored in printed/magnetic archives, updated when deemed necessary, shared, transferred, used, and processed in other ways by and within the SELLER and its current and future affiliates, subsidiaries, partners, successors, and/or third parties/organizations they designate and all service provider companies they work with and their shareholders and employees during the membership period. This data may also be transmitted to the relevant Authority and Courts in cases required by law. The CONSUMER accepts, declares, and undertakes that they consent and permit the use of the said data within the scope above, in accordance with the legislation on the protection of personal data and electronic commerce legislation, its transfer and sharing domestically and abroad, its processing, and the sending of commercial electronic messages and other communications to them.
10.3 - The CONSUMER has the following rights:
a. To learn whether personal data is processed,
b. To request information if personal data has been processed,
c. To learn the purpose of processing personal data and whether they are used in accordance with their purpose,
ç. To know the third parties to whom personal data is transferred domestically or abroad,
d. To request the correction of personal data if it is incomplete or incorrectly processed,
e. To request the deletion or destruction of personal data if the reasons requiring their processing cease to exist,
f. To request that the transactions made pursuant to subparagraphs (d) and (e) be notified to third parties to whom personal data has been transferred,
g. To object to the emergence of a result against the person himself by analyzing the processed data exclusively through automated systems,
h. To demand compensation for damages if personal data is processed unlawfully.
10.4 - If the CONSUMER notifies the SELLER via the specified communication channels not to send electronic commercial messages or not to process personal data, personal data processing and/or communications will be stopped within the legal maximum period according to the CONSUMER's explicit notification in this regard. The SELLER will delete the information from the data recording system, except for those that must be legally retained and/or are possible, or anonymize it in a way that the CONSUMER's identity is not identifiable. Applications and requests regarding the matters in Article 10.3 will be examined within legal deadlines, and a response will be given to the CONSUMER within the period stipulated in the legislation.

ARTICLE 11 – PRE-INFORMATION

The CONSUMER accepts, declares, and undertakes that they have been informed before this Agreement is concluded by the CONSUMER on the Website and before entering into an order or payment obligation, and that they have been informed by reading the "Pre-Information Form in accordance with Consumer Protection and Electronic Commerce Legislation" on the Website.

ARTICLE 12 – AUTHORIZED COURT

In the application of this agreement, Consumer Arbitration Committees up to the value announced by the Ministry of Customs and Trade and Consumer Courts in the place of residence of the CONSUMER or the SELLER are authorized.
